
Hearing Committee
The Hearing Committee (which is defined in the Association’s Declarations and Covenants, Article XIV, Section 3(b)) exists to provide a ‘check’ on the authority of the Board of Directors and the CAM in enforcing the Covenants, ARC Guidelines and reasonable Rules of the Association. When an observed violation of a rule exists, the Association provides written notice to the homeowner, requesting that the issue be corrected within some period of time. After 30 days, a second notice is sent, and then a third after another 30 days if the issue has not been corrected. In order to take any steps beyond just sending a written notice of a violation, the Covenants require an impartial hearing be conducted where the homeowner can present their case and the interpretation of the rules can be considered.
